Common questions about wills

Some life events automatically invalidate parts of your will:

  • Marriage cancels your entire will (unless it specifically says it’s made “in contemplation of marriage”)
  • Divorce cancels any gifts to your ex-spouse
  • Having children doesn’t cancel your will, but they won’t be provided for if you haven’t named them

Yes. You sign in front of both witnesses. They then sign in front of you and each other. All three of you need to be present for the entire process.

Witnesses can’t be beneficiaries in your will (or married to beneficiaries). If they are, their inheritance becomes invalid.

Emails, social media accounts, online banking, photos stored in the cloud—your executor needs access to these. Include instructions in your will or in a separate letter your executor can access.
